Public Offer
Terms & Conditions of portrait photography services
1. General provisions
This document is a public offer (public contract) of photographyporto.com, operated by Anastasiia Marchenko, based in Porto, Portugal. By booking and/or paying a deposit for a photography session, you (the Client) accept this public offer in full, in accordance with Articles 427 and 438 of the Civil Code of the Portuguese Republic.
2. Subject of the offer
The Photographer offers portrait photography services — individual, couple, family, maternity, fine art boudoir, personal brand and outdoor sessions — in Porto and the surrounding region (Braga, Aveiro, Coimbra, Guimarães). The exact session type, location, date and duration are agreed individually before booking.
3. Services & pricing
Sessions are provided in packages: Solo Photoshoot (€150), Couple Photoshoot (€180) and Creative Workshop (€200). Additional color-graded photos are available for €30. The current prices and package contents are listed on the Pricing page. The Photographer reserves the right to update prices; the price valid at the time of deposit payment applies to your session.
4. Booking & deposit
To confirm a date, a 50% deposit of the chosen package price is required. The deposit secures the date and time of the session. The remaining 50% is paid immediately after the photoshoot. The deposit is non-refundable.
5. Session conduct
The session takes place at the agreed location and time. The Photographer provides posing guidance, outfit and styling advice, and a studio wardrobe on request. The Client agrees to arrive on time; if the Client is late, the Photographer can wait up to half of the scheduled time, after which the session is considered cancelled.
6. Photo delivery & editing
Edited photos are delivered within 5–7 business days (Solo and Couple: 35–50 edited photos) in digital format. All photos are edited in the Photographer’s signature style. Natural editing is applied; heavy retouching or drastic changes to the face or body are not offered.
7. Usage rights & portfolio consent
The Photographer retains copyright over all photographs. By booking, the Client grants the Photographer permission to use the photos in her portfolio, website and social media unless the Client requests a private gallery in writing before the session. The Client may use the delivered photos for personal, non-commercial purposes. Commercial use requires a separate agreement.
8. Cancellation & rescheduling
The Client may reschedule the session once. To reschedule, notify the Photographer at least 48 hours before the scheduled time. If the Client cancels, the deposit is not refunded. If the Photographer cancels, the deposit is fully refunded or the session is rescheduled by agreement.
9. Refunds
The deposit is non-refundable. If photos cannot be delivered due to the Photographer’s fault, the paid amount is refunded in full. The Photographer is not responsible for results affected by the Client’s lateness, weather (for outdoor sessions) or other circumstances beyond her control.
10. Liability
The Photographer is not liable for lost or damaged personal belongings during the session. The Client is responsible for obtaining any necessary permits for shooting in public or private locations.
11. Privacy
Personal data provided in the booking request is processed in accordance with the Privacy Policy and GDPR. By submitting a request, the Client consents to the processing of their data for the purpose of organising the session.
12. Governing law
This public offer is governed by the laws of the Portuguese Republic. Any disputes are resolved by negotiation; unresolved disputes are subject to the jurisdiction of the courts of Porto, Portugal.
